Terms of Service

Agreement

If you use NISKA on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization. Additional order forms, MSAs, or data processing agreements may apply and control if they conflict with these Terms.

The service

NISKA provides an AI agentic Hotel Management System and related tools for hospitality operations. Features may evolve. Beta or preview features are provided as-is and may change or be withdrawn. You are responsible for configuring agents, policies, and integrations appropriately for your properties.

Accounts and access

You must provide accurate account information, safeguard credentials, and promptly revoke access for users who leave your organization. You are responsible for activity under your accounts, including agent-initiated actions executed within permissions you grant.

Acceptable use

You may not misuse the service, attempt unauthorized access, interfere with platform integrity, reverse engineer except where allowed by law, use the service to violate law or third-party rights, or submit unlawful, harmful, or infringing content. We may suspend access for abuse or risk to the platform or other customers.

Intellectual property

NISKA and its licensors own the platform, software, models, branding, and documentation. You retain ownership of your customer data. You grant NISKA a limited license to host and process customer data solely to provide and improve the service as described in our Privacy Policy and agreements.

Disclaimers

Except as expressly stated in a signed agreement, the service is provided “as is” and “as available.” AI outputs are probabilistic and may be incomplete or incorrect; you remain responsible for operational decisions and for reviewing agent actions before or after execution according to your policies.

Limitation of liability

To the maximum extent permitted by law, NISKA will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill. Our aggregate liability for claims relating to the service is limited as set out in your applicable commercial agreement, or if none, to fees paid to NISKA for the service in the twelve months before the claim.

Suspension and termination

You may stop using the service at any time. We may suspend or terminate access for material breach, non-payment, legal risk, or platform security. Upon termination, your right to access the service ends, subject to any contractual data return or deletion terms.

Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, unless a signed agreement states otherwise. Courts in India have exclusive jurisdiction, subject to mandatory consumer protections where applicable.
